Terms of Use
The short version. This website belongs to the Weimaraner Club of America. By using it you agree to these terms. The members' area and the registry are for current members, for club purposes. Payments go through Stripe and follow the club's own rules on refunds. The club may change these terms at any time, and continued use after a change is agreement to the change.
1. Who we are, and agreement
This website (the "site") is operated by the Weimaraner Club of America, Inc. (the "club", "we", "us"), a not-for-profit organization and the American Kennel Club parent club for the Weimaraner. By visiting the site, creating a login, or buying anything through it, you agree to these Terms of Use and to our Privacy Policy. If you do not agree, do not use the site.
2. Changes to these terms
The club may change these terms at any time, at its sole discretion, by publishing the new version on this page with a new version number and date. A change takes effect when it is published. Using the site after a change is your agreement to the changed terms. Where we record your acceptance, we record the version you accepted.
3. Member logins
- Logins are for adult members of the club in good standing. A junior member does not hold a login; the junior's household is covered by the adult members' logins.
- Your login is personal. Do not share it, and do not sign in as someone else. If you believe your login has been used by another person, change your password and tell us.
- You are responsible for keeping your contact details, including your email address, current on your record.
- Access to the members' area ends when a membership lapses, and resumes when it is renewed. The club may suspend or remove a login where these terms, the club's by-laws or the Code of Ethics are broken, or where the board has acted under the by-laws.
4. Members' area and the registry
- Material in the members' area, including the magazine archive, the membership roster, the Registry of Merit and Field Registry of Merit records, the pedigree database and the breeding tools, is provided for members' personal, non-commercial use in connection with the club and the breed.
- Do not copy, scrape, republish, sell or distribute members' area material, or other members' contact details, outside the club without the club's written permission. Using the roster for unsolicited commercial or political contact is not permitted.
- The registry records are compiled by club volunteers from show and field results and from American Kennel Club records. The club works to keep them accurate, but they are provided as they are, without warranty, and they are not an official American Kennel Club record. Please report an error to the Records Committee rather than relying on it.
5. Purchases, dues and refunds
- Card payments are taken by Stripe, our payment provider, on its secure pages. The club never sees or stores your card details.
- Prices are in United States dollars. The price shown at checkout is the price charged.
- Membership dues, applications, nominations, entries, advertising and donations are subject to the club's by-laws and the rules of the committee concerned. In general dues, entries and nominations are not refundable once accepted, except as those rules provide or as the board decides. A membership application that the board does not accept is refunded.
- Merchandise is refundable if returned unused within 30 days, less any shipping.
- A refund, when one is due, goes back to the card that paid.
- Donations are voluntary; whether a donation is deductible for tax purposes depends on your circumstances and the club's status at the time, and the club does not give tax advice.
6. Membership and the club's rules
Applying for or renewing membership through the site is subject to the club's by-laws and Code of Ethics, and an application is complete only when the club has accepted it under those rules. Nothing on the site changes the by-laws, and where the site and the by-laws differ, the by-laws govern.
7. Content you submit
Where the site lets you submit material - a photograph for a contest, an advertisement, a nomination, a pedigree entry, a record correction - you confirm that you have the right to submit it and that it is accurate to the best of your knowledge. You give the club permission to use it for the purpose you submitted it for, including publication in the club's magazine and on this site, with credit where credit is usual.
8. Acceptable use
Do not attempt to gain access you have not been given, probe or test the site's security without the club's written permission, interfere with its operation, upload anything harmful, or use the site in a way that breaks the law. The site keeps a record of sign-ins and of administrative actions.
9. Links to other sites
The site links to other organizations, including the American Kennel Club, local clubs and businesses that support the club. Those sites are not ours and we are not responsible for them.
10. Intellectual property
The club's name, logos, the magazine, and the design and text of the site belong to the club or are used with permission. Photographs belong to their photographers. You may view and print pages for your own use in connection with the club. Any other use needs permission.
11. Disclaimer and limitation
The site is provided "as is" and "as available." The club does not promise that it will be uninterrupted or error-free, or that any information on it is complete or current. To the fullest extent the law allows, the club, its officers, directors, committee members and volunteers are not liable for any loss or damage arising from use of the site or reliance on anything in it, and the club's total liability for any claim relating to the site is limited to the amount you paid the club through the site in the twelve months before the claim arose. Nothing here limits liability that cannot be limited by law.
12. Governing law
These terms are governed by the laws of the State of Ohio and the United States, without regard to conflict-of-law rules. Any dispute that cannot be settled between us will be brought in the state or federal courts in Ohio, and you agree to their jurisdiction.
13. Contact
Questions about these terms go to the Executive Secretary, whose contact details are on the Contact page. Trouble signing in: see Login Support.
